Passenger Transportation Agreement
1-Parties
This Passenger Transportation and Service Agreement is signed with "MARÇAM SEA TRA VEL AGENCY (hereinafter referred to as "AIRPORTSHUTTLE34")" www.airportshuttle34.com it has been concluded between the passengers who have made a reservation on Dec and/or on whose behalf the reservation has been made. (Hereinafter referred to as "Passenger").
Unless otherwise specified in this Agreement, AIRPORTSHUTTLE34" and Passenger shall be referred to separately as "Party" and together as "Parties".
2-Topic
With this Agreement, the Parties agree that for airport transfers within the borders of Turkey, both before and after the flight, the transfer service purchased by passengers in the directions of airport to address or address to airport is provided by the specified vehicles, and this service is charged by "". They have submitted an offer to AIRPORTSHUTTLE34 at the price specified within the framework of the Contract terms set out below.
3- Service and Payment Information
3.1. The contract price, including tax, is specified in the service details.
3.2. I acknowledge that all fees related to the transfer service I have received and/or will receive under this Agreement will be collected by AIRPORTSHUTTLE34 using the credit card I enter on the IYZICO screen, and I authorize AIRPORTSHUTTLE34 to make the payment. 4- General provisions
4.1 The passenger is obliged to comply with all relevant legislation, particularly the Highway Traffic Act, and must adhere to all rules within the framework of the legislation, such as properly fastening the seat belt. Regarding vehicle safety rules.
4.2 When a passenger acquires the transfer service via credit or debit card, they accept the written terms of the relevant agreement, even if they have not signed the service contract.
4.3
In order to benefit from the transfer service subject to this Agreement, the passenger must make a reservation at least 4 hours before the transfer time. For religious and national holidays, New Year's Eve, and other official holidays, reservations must be made at least 48 hours before the transfer time. The reservation can be canceled by the passenger up to 48 hours before the transfer time. In this case, the passenger will be refunded the service fee they paid. No refund will be provided for cancellations made outside the specified hours.
4.4 The Passenger has no authority to change the route in all travel services. Requests by the Passenger to stop at a different location between the designated route and to wait for a period of time at that location will not be accepted. In the VIP transfer service, different point requests other than the route(s) specified in the contract are charged for each different point.
4.5
For the transfer service provided by AIRPORTSHUTTLE34, which has sole discretion over all aspects of the service, the passenger must be assigned a vehicle that corresponds to the number of passengers and luggage volume specified when purchasing the transfer service. AIRPORTSHUTTLE34 hereby acknowledges and undertakes that all vehicles to be allocated for the service subject to this Agreement will be fully insured against personal accident and seat liability, that periodic maintenance of the vehicles will be performed within the prescribed timeframes, and that all necessary spare parts and materials will be provided in full. The vehicle will be equipped with wheels, first-aid kit, fire extinguisher, and reflector. AIRPORTSHUTTLE34 will not be held liable in the event of a traffic accident or other incident occurring during the transfer that results in bodily injury or property damage to the customer or damage to the transported goods. In such a case, the customer irrevocably acknowledges and declares that AIRPORTSHUTTLE34 shall not be liable under Article 66 of the Turkish Code of Obligations and other provisions of legislation.
4.6 Except for the acceptance by AIRPORTSHUTTLE34 of the passenger and luggage information provided by the passenger during purchase, passengers or luggage exceeding the limits accepted by AIRPORTSHUTTLE34 cannot be accepted into the vehicle. If the passenger renounces the transfer service for this reason, no refund will be issued.
4.7 When necessary, the vehicle personnel who will carry out the passenger transfer are obliged to prove to the legal authorities that the service purchaser is the customer by presenting valid identification documents and the reservation confirmation. The customer who fails to fulfill this obligation will not be transferred. However, AIRPORTSHUTTLE34 may provide this service to the Passenger if it determines that the credit card holder who made the reservation has given their consent for the Passenger to use this service.
4.8 iAIRPORTSHUTTLE34 is not responsible for the loss or damage of any items left by the customer in the vehicle during the transfer. In such a case, the passenger must contact the AIRPORTSHUTTLE34 call center and pick up the forgotten item from the provided address if it is found.
4.9 AIRPORTSHUTTLE34 transfer vehicles do not accept bags, crates, boxes, etc. as luggage. The passenger's maximum baggage allowance per person is 1 handbag and 1 suitcase (handbag weight: 8 kg, accompanying suitcase: not exceeding 32 kg). The passenger acknowledges, undertakes and declares that the luggage subject to transfer does not contain flammable, combustible, explosive, narcotic, liquid, odorous or radioactive substances that are prohibited from being transported or possessed under the Turkish Penal Code. If the driver notices the presence of the items listed in the luggage, that luggage will not be accepted into the vehicle. Additionally, in these cases, the passenger cannot claim any debt or demand against AIRPORTSHUTTLE34, regardless of the name under which such claim is made. In the trunk; If the presence of the above-mentioned items is detected, AIRPORTSHUTTLE34 will immediately report the situation to the relevant authorities. The presence of the listed items shall not be detected by the driver; in case the vehicle is stopped and searched by law enforcement during transfer, any damage or loss incurred by AIRPORTSHUTTLE34 and/or any person due to this shall be promptly and fully compensated in cash by the passenger.
4.10 In our transfer vehicles, pet transportation is carried out in a secure cage, in a manner that does not disturb other passengers, and only upon prior notification during booking. Only cats, dogs, and small songbirds are transported as pets.
Cage dimensions must be maximum 23*40*55.
4.11 Passenger information
4.11.1 The passenger will be provided with reservation information or preliminary details regarding the service they have purchased via email and/or SMS. The passenger is responsible for the accuracy of the phone number and email address they provide. AIRPORTSHUTTLE34 cannot be held responsible if the contact information provided is incorrect and the information cannot reach the passenger.
4.11.2 For shared transfers purchased, the estimated pick-up time will be shared with the passenger via email and/or SMS 12 hours prior to the transfer. In VIP service, the pick-up and drop-off times will be determined by the passenger themselves.
4.12 For transfers from a specific point to the airport, AIRPORTSHUTTLE34 declares and undertakes that the vehicle assigned for the transfer will be at the designated point at the scheduled transfer time. Prior to the designated transfer date and time, the passenger is informed via email and SMS. As of the transfer time notified to the passenger, any extraordinary circumstances, unexpected events, force majeure, flooding, hail, rain, traffic congestion, etc., occurring in the transfer vehicle are not the responsibility of the service provider. Situations like this may occur. A delay of 20 (twenty) minutes will be considered a reasonable delay. Except for the reasons listed. At transfer points such as residential complexes or sites, AIRPORTSHUTTLE34 is not responsible for delays exceeding 20 (twenty) minutes caused by security guards preventing the vehicle from entering the site. In this case, if 20 (twenty) minutes are exceeded and the passenger does not wait for the vehicle, no refund will be provided. Passengers must be at the designated pickup point with their luggage at the scheduled transfer time. In case the passenger is not present at the transfer point at the scheduled transfer time, the vehicle assigned to AIRPORTSHUTTLE34 must wait for the passenger for 10 (ten) minutes. If the passenger does not reach the designated point with their luggage within 10 (ten) minutes, the vehicle is under no obligation to wait any longer. Time notifications regarding AIRPORTSHUTTLE34 operations, the call center, and drivers will be binding on all parties.
4.13 In cases where the flight number is not provided for any reason, in case of a delay, or if waiting time exceeds 1 (one) hour, AIRPORTSHUTTLE34 will no longer have to wait for a vehicle at the airport. For shared transfers, transfers are carried out by AIRPORTSHUTTLE34 according to available time slots and vehicle availability. For VIP service, AIRPORTSHUTTLE34 assigns a suitable vehicle to provide the service.
4.14. The terms of the agreements and campaigns made with contracted companies will apply. AIRPORTSHUTTLE34 is responsible for ensuring that the vehicles reach the designated pick-up points to the passenger at the promised time. In the event that the passenger is unable to travel to their destination using the approved vehicle due to a problem originating from AIRPORTSHUTTLE34, they will be provided with a second vehicle at no additional cost. In case the second vehicle fails to reach the Passenger's address on time or the Passenger does not arrive on time with the second vehicle, all necessary alternative transportation expenses for the Passenger to reach the airport will be covered by AIRPORTSHUTTLE34. In cases where the passenger is forced to use another means of transportation (e.g., a commercial taxi, public transportation, or their own vehicle), the service will be provided free of charge again at the passenger's desired time or for the amount paid for the service. 4.15. At the transfer point, the vehicle driver is not obligated to leave the vehicle and accompany the passenger to the vehicle or to their destination.
4.16. Children under the age of 16 will not be transferred without adult supervision or their parents' permission.
4.17. For shared transfers, if a wheelchair transfer is required along with the passenger to be transferred, this must be indicated by the passenger during the reservation. Otherwise, the Passenger will be held responsible for any damages that may arise due to delay and/or failure to board the vehicle. Physically disabled passengers who are capable of meeting their personal needs may travel alone without a companion. However, Passengers who are unable to meet their personal needs must be transferred with a companion. For this companion, the necessary reservations must be made and the fee must be paid.
4.18. When purchasing tickets online using your credit card, your bank may charge an additional transaction fee on top of the ticket price. For detailed information, the passenger should contact their bank.
5. CANCELLATION AND REFUND POLICIES
5.1. In case the deadlines specified in this Agreement expire and/or the conditions are not met, the right of cancellation cannot be exercised and AIRPORTSHUTTLE34 will not provide a refund.
5.2 Make your reservation from the AIRPORTSHUTTLE34 website (www.airportshuttle34.com ), if you received it from the mobile application or call center, you can make your changes and cancellations 12 hours in advance through any of the online sales channels or through the call center REF (with your REF). 5.3. AIRPORTSHUTTLE34 shall not be liable if the passenger fails to comply with the obligations under this Agreement and/or if the reservation is canceled due to any fault or negligence on the passenger's part and/or if the passenger takes such action. 5.4 AIRPORTSHUTTLE34 reserves the right to retain transaction amounts until the date on which the Member approves the Payment Transaction, particularly in the following cases: when Suspicious Transactions are detected and when notification is provided by the User or System Partner. Provided that the suspicious situation is documented, payments will not be processed definitively if it is confirmed.
– Suspicion exists that the payment transaction does not comply with legal provisions,
– If there is suspicion that the Payment Transaction was processed without the knowledge of the credit card holder used in the Payment Transaction,
– If there is suspicion that the Payment Transaction was processed without the knowledge of the bank account holder used in the Payment Transaction,
– If there is any suspicion that the Payment Transaction is not a genuine Payment Transaction (excluding tests).
5.5. Rules to be followed when traveling with AIRPORTSHUTTLE34;
-Do not consume alcohol or drugs while traveling in the vehicle.

5.6 This Agreement shall be governed by the laws of TURKEY. The courts and enforcement offices shall have jurisdiction to resolve any dispute arising from the interpretation or implementation of this Agreement between the parties.
